What
is Mediation?
Mediation, a form of
alternative dispute resolution (ADR), aims to assist
two (or more) parties in reaching an agreement. An
agreement reached by the parties is preferred over
accepting a decision imposed by a third party.
Disputes can arise within families, organizations or
business relationships. Mediated divorce
settlements, including child custody arrangements
and property settlement, can often be accomplished
at much lower cost and with less anxiety than
through litigation.
The mediator is impartial in the mediation process
and uses appropriate techniques and skills to open
and improve dialogue between disputants. The
mediator will help the parties reach an agreement on
the disputed matter.
Mediation is quick, private, fair, and inexpensive
compared to litigation. Mediation sessions are
usually scheduled quickly -- and most sessions last
only a few hours or a day, depending on the type of
case. In contrast, litigation may take many months
to resolve. |
